The principles for real estate sales at the notary have been determined

The regulation determining the principles for real estate sales at notaries has been published. However, the implementation will start on the date specified on the website of the Ministry of Justice, where the information system specified in the notary law is established. According to the regulation determining the principles to be applied to real estate sales contracts prepared by notaries, which is included in today's Official Gazette, applications regarding the preparation of real estate sales contracts will only be made using the e-Government portal of the "e-appointment/application" application of the Notaries Union. The notary will forward the application document he/she has prepared to the General Directorate of Land Registry and Cadastre via the Land Registry and Cadastre Sharing System (TAKPAS) and will query the detailed land registry information and other information and documents regarding the real estate via TAKPAS. The notary will personally perform the transactions related to the contract, determine that there is no legal situation preventing the sale, have the contract signed by the parties and record it in the Land Registry and Cadastre Information System (TAKBIS). The notary fee in this context cannot be less than 500 TL and more than 4,000 TL, depending on the value of the real estate.
